Serge Svetnoy, lighting director of Rust, is suing Alec Baldwin, gunsmith Hannah Gutierrez-Reed, first assistant director David Halls, props master Sarah Zachry, gunsmith Seth Kenny, and the director of the film.
He accused everyone of negligence and inaction:
This incident was caused by the negligence and omission of the Defendants, as well as their agents, supervisors and employers. Simply put, there was no reason for a live bullet to be placed in a revolver on the set of Rasta, and the mere presence of a bullet in a revolver posed a deadly threat to anyone nearby.
According to Serge, the shot that claimed the life of cameraman Galina Hutchins and wounded director Joel Sauce almost hit Serge himself. He was near the deceased operator. After being hit by a bullet, the woman died in his arms, as a result of which he received a severe emotional breakdown.
The lawsuit states that the weapon was loaded with live ammunition. However, the film's manual had previously claimed that Alec Baldwin fired blanks. The police are still trying to find out this information.
